Terms of Service
1. Who we are and what this covers
"Yardstick," "we," "us" and "our" mean Yardstick Estimate. "You" means the business that signs up. These terms apply when you create an account, start a trial, or use the Yardstick estimate widget, your client portal or any related page (together, the "Service"). By starting a trial or using the Service you agree to these terms and to our Privacy Policy.
2. The Service
Yardstick provides an embeddable tool that lets visitors to your website trace their lawn on a map and receive an instant estimate based on the pricing and service area you set. When a visitor submits their details, we store the lead and email it to you. You can see your leads in your client portal.
3. Free trial, billing and cancellation
- Free trial. Your first 14 days are free. We usually ask for a card to start the trial (some invited trials start without one), and you are not charged during the trial.
- After the trial. Unless you cancel before the trial ends, your card is charged $49 per month plus any applicable sales tax, on the same date each month. Sales tax is based on your billing address, and the total is shown before you confirm. By starting a trial you authorize us, through our payment processor Square, to charge your card on that schedule until you cancel.
- The trial is your decision period. If you cancel before the 14 days end, you will not be charged. We do not offer refunds or credits for charges already made, for partial months, or for unused time, except as described under "Canceling" below.
- Canceling. You can cancel yourself, any time, from the Your subscription section of your client portal (sign in with the email you used to sign up). No email or phone call is needed. Cancellation stops future charges. The Service stays active until the end of the period you have already paid for (or the end of your trial), and then your widget stops accepting new estimates. If you cannot use the portal, email contact@yardstickestimate.com and we will cancel for you.
- The cancel-by time. Your card is charged at the moment your trial ends. Because that moment is set in universal time (UTC), it may fall on a different date and hour where you are. To keep this simple, your portal shows a cancel-by deadline in your own local time (noon on the day before your trial ends). If you cancel by that deadline, you will not be charged.
- If you are charged by mistake. If you canceled before the cancel-by deadline shown in your portal, or tried to cancel and were charged anyway because of a time-zone or timing issue, email us and we will refund that charge.
- Price changes. We may change the price. We will give you at least 30 days' notice by email before a new price applies to you, and you may cancel before it takes effect.
- Payments are handled by Square. Your card number goes directly to Square. Yardstick does not see or store it.
4. Failed payments
If a charge fails (for example, an expired card), we may give you a short grace period, currently 3 days, to fix it. If the payment is still unresolved after that, we may switch your widget off until you pay. We keep your data while your widget is off (see section 7).
5. Your responsibilities
- Provide accurate information, including your business details, your pricing and your service area. The estimates your customers see come from the pricing you enter, so you are responsible for it.
- You are responsible for how you contact leads. If you call, text or email people who submit an estimate, you must follow the laws that apply to you, including consent rules for calls and texts (such as the Telephone Consumer Protection Act) and email rules (such as CAN-SPAM). The consent wording in the widget is a starting point and not legal advice.
- Keep your login secure, and tell us promptly if you think someone else has access.
- If you use the Manual estimate tool to email an estimate, only enter the email address of a customer who asked you for one.
- Do not misuse the Service. That includes trying to break or overload it, scraping it, reselling or white-labeling it without our written permission, or using it for anything unlawful.
6. Estimates are estimates
The widget produces automated estimates from a map outline the visitor draws and from the prices you set. Measurements and map data can be imperfect. An estimate is not a binding quote unless you choose to honor it. Yardstick is not a party to any agreement between you and your customers and is not responsible for the price you agree on or the work you perform.
Before seeing a price, visitors confirm that it is an estimate based on satellite imagery that may vary based on terrain, obstacles, or access, and that a firm quote will be provided before any work is started. We record when they confirmed and show it to you with the lead. That confirmation sets expectations; it does not make the estimate binding on you or them.
7. Your data and your leads
- Your leads are yours. You own the leads and the information your customers submit through your widget. You give us permission to store, process and deliver that information to run the Service.
- We keep your data. We keep your account information and your leads even if you cancel or your widget is switched off, so your records are still there if you come back. We do not delete leads on a timer.
- Export and deletion. You can ask us at any time to send you a copy of your data or to delete it, and we will do so within a reasonable time. Email contact@yardstickestimate.com.
- How we handle personal information is described in our Privacy Policy.
8. Third-party services
The Service relies on outside providers such as Square (payments), Google (maps and address search), other imagery and public map-data providers, and our hosting and email providers. Those providers have their own terms. We are not responsible for outages or changes at those providers, though we will try to keep the Service working.
9. Availability and no guarantee
We work to keep the Service running, but we do not promise it will always be available, error-free or perfectly accurate. The Service is provided "as is" and "as available," without warranties of any kind to the fullest extent the law allows. We may update, change or pause features from time to time.
10. Limits on our liability
To the fullest extent the law allows, Yardstick will not be liable for lost profits, lost leads, lost jobs, lost data or any indirect, incidental or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 3 months before the claim arose. Some places do not allow certain limits, so parts of this section may not apply to you.
11. Indemnity
You agree to defend and reimburse Yardstick for claims and costs that come from your misuse of the Service, from the pricing or content you provide, or from the way you contact or serve your customers.
12. Ending the relationship
You may stop using the Service at any time (see section 3). We may suspend or end your access if you break these terms, if charges go unpaid, or if we reasonably think your use puts the Service or other people at risk. Sections that by their nature should continue after termination (including 7, 10, 11 and 14) will continue.
13. Changes to these terms
We may update these terms. If a change is significant, we will tell you by email or in the Service before it takes effect. Continuing to use the Service after a change means you accept it. The "Last updated" date above shows the current version.
14. Governing law
These terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Pennsylvania, and you agree to their jurisdiction.
